JOBN GmbH, FN 475010w, Sillgasse 8a, 6020 Innsbruck, ("Provider") operates under the domain https://www.tirol-toursim-jobs.com and under the app "Tirol Tourism Jobs", among other things, a platform for the placement of employment relationships (together "App"), by means of which the user ("User") is enabled to get to know services offered by the Provider and to establish contacts with potential employers. The use of the App is made possible on the basis of the following provisions.
Use is only possible for registered users.
The provision of the necessary technical requirements for access to the app is the responsibility of the user, who shall also bear all access and data transfer costs. The user shall also ensure that his IT system has the security precautions to be expected according to the current state of the art and that all security updates for the installed operating system are available.
- Registration and app use
The user must provide certain data in the app so that a user account can be created and the app can be used.
The user undertakes to publish only correct and complete information on his/her profile and to update it regularly. The user is not obliged to use a truthful profile photo.
In any case, it is prohibited to publish illegal or potentially offensive information on the user's profile. The user may only use the app for personal searches for potential employment contracts. Use on behalf of or in the name of third parties is also prohibited, as is the creation of fake profiles.
The provider reserves the right to block or temporarily block users who violate these terms of use without prior notice, without the user being able to derive claims of any kind against the provider or third parties.
The mere use of the app is currently free of charge. The provider reserves the right to monetise the offer by placing online advertising or to charge for it in some other way.
The provider is exclusively entitled to the provider's industrial property rights.
This content is protected by copyright, trademark law and/or other laws. The provider's intellectual property may not be utilised or impaired or used in any other way without the express written consent of the provider.
Intellectual property may not be copied, reproduced, modified, downloaded, transmitted or otherwise utilised without the prior written consent of the provider. By using the services, the user does not acquire any industrial property rights.
- Data protection
The user's personal data collected in the course of use is processed in accordance with the relevant data protection provisions in the respective applicable version. Details of data processing can be found in the provider's privacy policy in the respective applicable version.
The Provider provides all services on an "as is" and "as available" basis and points out that all warranties of any kind are excluded.
The provider does not guarantee that the services meet the needs of the users, are secure, or are available without interruption, promptly, accurately or error-free.
The user is aware that the services accessible via the Internet are subject to typical failure risks that cannot be controlled by the provider. In this respect, the provider accepts no liability for the uninterrupted functionality and accessibility of the app.
In particular, necessary maintenance work, compelling security reasons and events that are beyond the control of the provider (e.g. disruptions to public communication networks and the Internet, power failures or similar events) may lead to disruptions or to the temporary suspension of the availability of the app and the website.
The provider is free to discontinue or change individual services, the website or the app with immediate effect without the user being able to derive any claims from this. The provider is also not liable if services are partially or completely unavailable due to technical circumstances.
The receipt of content through the use of the services (e.g. downloading or following links) is at the user's own risk. The provider accepts no responsibility or liability for the deletion or incorrect storage or transmission of any content. The provider is not liable for the loss, misuse or unauthorised use of login data.
The provider may amend or adapt these terms of use at any time. By using the services after the changes come into effect, the user gives his consent to the changes.
- Place of jurisdiction and applicable law
The place of jurisdiction and applicable law shall be governed by the GTC.
